  • State parental leave is available for employees who are not eligible for FMLA protected leave.  It cannot exceed 12 weeks from the date of birth/adoption.  It does not include state contribution for health insurance for any full month the employee is in a leave without pay status.
  • FMLA and State Parental Leave establish 12 weeks of protected leave running concurrent with sick leave (if applicable), annual leave (if applicable), or leave without pay.
  • To be eligible for FMLA protected leave, the employee must have worked for the state for at least 12 months and at least 1,250 hours over the previous 12 months at the time the leave is needed.
  • Sick leave is not available for bonding time, but annual leave is available
  • If husband and wife both work for the State, they can take a combined total of 12 weeks of FMLA leave for birth or adoption/foster care of a child.

The only difference between faculty and staff parental leave is that 9-month faculty do not take parental leave during the summer months, and they do not have vacation available to stay in a paid status for protected parental leave time during the 9 month school year (sick leave is still available if applicable).
